Hemp CBD Oil is legal without a prescription and can be purchased in all 50 states with THC of .3% or less.
Although recently some states have overridden Federal law and made it illegal. Those states are: South Dakota, Indiana. Before purchasing Hemp derived CBD it is advised to check with your state laws.
Hemp is not a drug and can legally be sold the same way that hemp protein powders, hemp hearts or hemp food can be sold and advertised through the United States.
President Obama signed the Farm Bill of 2014, which made some hemp products legal throughout the US.
In the Farm Bill, Section 7606, permits universities and state departments of agriculture to cultivate industrial hemp for limited purposes through research pilot programs.
2015 Consolidated Appropriations Omnibus Act, Congress supported this ruling which further protects Hemp CBD from DEA action. DEA opposition of Hemp CBD would be in direct violation of this federal law. Sections 543 and 763 in the Omnibus Act states that it is unlawful for federal funds to be used in contradiction to the Farm Bill Act. The Omnibus Act states that the Department of Justice and the DEA is not permitted to use federal funds to inhibit the industrial hemp research authorized under Section 7606 of the 2014 Farm Bill.
